Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Ondjila AI platform, website, and services (collectively, "the Platform") operated by Unqo Digital Solutions CC ("we", "us", "our"), registered in Namibia (CC/2025/04516). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. About Ondjila AI

Ondjila AI is an Africa-first AI education platform offering practical, industry-specific AI training to professionals and students worldwide. The Platform provides online courses, learning tracks, AI-assisted tutoring, certificates of completion, and related educational services.

2. Eligibility

You must be at least 16 years old to use the Platform. By using the Platform, you represent and warrant that:

  • You are at least 16 years of age
  • You have the legal capacity to enter into a binding agreement
  • You will use the Platform in compliance with these Terms and all applicable laws
  • The information you provide to us is accurate and complete

If you are using the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

3. Accounts

When account registration becomes available, you will be required to create an account to access paid content and features. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the security of your password and account credentials
  • Notify us immediately of any unauthorised access to your account
  • Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are involved in fraudulent activity.

4. Waitlist

By joining the Ondjila AI waitlist, you agree to receive emails regarding the platform launch, early access invitations, and founding member offers. You may unsubscribe at any time by clicking the unsubscribe link in any email or contacting us at hello@ondjila.ai. Joining the waitlist does not constitute a contract for services or guarantee access to any specific pricing or features.

5. Courses, Content and Licences

All courses, videos, texts, assessments, AI interactions, illustrations, and other materials on the Platform ("Content") are owned by or licensed to Unqo Digital Solutions CC and are protected by copyright and intellectual property laws.

Upon purchasing a course or subscribing to a plan, we grant you a limited, non-exclusive, non-transferable, personal licence to access and view the Content for your own personal or professional development. You may not:

  • Download, copy, reproduce, or redistribute any Content
  • Share your account credentials or access with others
  • Use Content for commercial purposes, resale, or to train AI models
  • Remove or alter any copyright, trademark, or proprietary notices
  • Scrape, crawl, or use automated tools to extract Content

Course access is per-seat. Organisation accounts may have multiple seats as defined in their plan.

6. Payments, Pricing and Refunds

Pricing for courses and subscriptions is displayed on our Pricing page in Namibian Dollars (N$) and may also be displayed in USD or other currencies depending on your location.

Payments

  • All payments are processed securely by third-party payment providers
  • We do not store your card or banking details
  • Prices are subject to change; changes will not affect already-purchased access
  • Founding member pricing is locked in for the lifetime of your account as long as your subscription remains active

Refunds

  • You may request a full refund within 7 days of purchase if you have completed less than 20% of the course
  • No refunds are issued after 7 days or after significant course progress
  • Subscription fees are non-refundable once a billing period has started

Organisation accounts

  • Organisation pricing is quoted separately and governed by a separate agreement
  • Invoicing and payment terms are agreed at the time of onboarding

7. Certificates

Upon successful completion of a course or track, you will receive a digital Certificate of Completion issued by Ondjila AI. These certificates:

  • Confirm completion of the course material as assessed by the Platform
  • Are not accredited qualifications unless explicitly stated
  • May be shared on LinkedIn, CVs, or professional profiles
  • Remain valid and accessible through your account indefinitely
  • May be revoked if obtained through dishonest means or academic misconduct

8. AI Features and Tutoring

The Platform includes AI-assisted tutoring and learning features. You acknowledge that:

  • AI-generated responses are for educational purposes and may not always be accurate
  • You should verify AI-generated information before applying it professionally
  • We are not liable for decisions made based on AI-generated content
  • AI features may be updated, modified, or discontinued at any time
  • You must not use AI features to generate harmful, illegal, or misleading content

9. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of others
  • Upload or transmit viruses, malware, or harmful code
  • Attempt to gain unauthorised access to the Platform or its systems
  • Harass, abuse, or harm other users
  • Impersonate any person or organisation
  • Engage in any activity that disrupts or interferes with the Platform
  • Use the Platform for any unlawful or fraudulent purpose
  • Circumvent any access controls or content restrictions

We reserve the right to suspend or terminate your access immediately for any violation of these terms.

10. Organisation Accounts

Organisations purchasing seats for their employees or members agree to:

  • Ensure all seat users comply with these Terms
  • Manage seat assignments responsibly through the admin dashboard
  • Not exceed the number of purchased seats
  • Take responsibility for usage within their account

Organisation-specific data processing agreements (DPAs) are available on request.

11. Third-Party Links and Services

The Platform may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or availability of third-party sites. Links do not constitute endorsement.

12. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • The Platform will be uninterrupted, error-free, or secure
  • Course content will lead to specific career outcomes or employment
  • AI-generated content will be accurate or complete
  • The Platform will meet your specific requirements

13. Limitation of Liability

To the maximum extent permitted by applicable law, Unqo Digital Solutions CC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Platform, including but not limited to loss of data, loss of profits, or loss of business opportunity.

Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Unqo Digital Solutions CC, its directors, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Namibia. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Namibia.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Platform at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
